Effective July 31, 2023, New Jersey Senate Bill S2357 established a mandatory requirement that New Jersey employers report employee separations to the New Jersey Department of Labor. Implementation and enforcement of this law were delayed until the Department developed an electronic reporting platform.

The New Jersey Department of Labor has now launched its Employer Response Portal, through which employers can create profiles and comply with the reporting requirement. To create a profile, employers must register for Employer Access by filing Forms NJ-927 and WR-30.

Once registered, New Jersey employers must report an employee’s separation within seven days. Reportable separations include layoffs, terminations, voluntary resignations, and retirements. Failure to report on time may result in a fine equal to the greater of $500 or 25% of any amount of unemployment benefits fraudulently withheld, with penalties accruing for each day the report remains unfiled.

With the Employer Response Portal now available, employers should update their reporting practices and procedures to comply with these requirements. They should also ensure that responsible human resources personnel can access the portal and are trained to submit the required information to the New Jersey Department of Labor on time.
